This paper identifies a volitional theory of meaning common to speech act theory and legal positivism, represented by Hart and Kelsen. This model is compared and contrasted with the model of social operations developed by Reid, a Common Sense Enlightenment philosopher. Whereas the former subscribes to the view that meaning is generated by acts of will, the latter finds meaning to consist of the dual elements of sign and 'directedness'.The ability of positivist theories to provide a structural account of the (...) difference between legal rules and other rules is inextricably linked to this commitment to the volitional theory of meaning. The commitment to the volitional view however leads to problems in requiring that some kind of authority be presupposed in for plain rules to attain legal force. Such authority can only be established with recourse to further rules or must be accepted as a matter of faith. Reid's criterion of direction however vitiates the need for an authority, instead accounting for social communication in general, and rules in particular, in terms of sociological factors. Although no comprehensive critique of the volitional theory is proposed, Reid's model is preferable on the grounds of explanatory richness.The core claims of the paper are that: legal positivism necessarily subscribes to the volitional theory of meaning; rejection of the volitional theory necessarily entails rejection of the positivist view that legal and non-legal rules can be differentiated on structural grounds another counter-model exists which avoids some of the pitfalls of the volitional theory; if the volitional theory is rejected then the existence of rules can only be accounted for in a 'strong' sociological sense and legal theory must accordingly accept the dominant role of sociology in conceptualising the nature of rules. For students of the poet, Robert Fallon's _Milton in Government_ fills a gap in modern knowledge of his life, the ten years he labored as Secretary for Foreign Languages to the English Republic. For Interregnum historians, the book offers a study of the international affairs of the Republic from a unique perspective, as well as a detailed analysis of the government bureaucracy that conceived and articulated foreign policy during the 1650s. Milton's decade of public service to the English Republic, (...) and the collection of State Papers which are the product of those years, have been either misunderstood or largely ignored by Miltonists, and their influence upon his poetry all but dismissed. Making extensive use of the State Papers Foreign in the Public Record Office, hitherto overlooked by literary scholars, and the Calendar of State Papers Domestic, Fallon offers the first definitive description of the poet's place in government. He finds Milton to be an indefatigable and highly knowledgeable public servant, closely involved in the expression of foreign policy, and responsible for many more documents than have been previously ascribed to him. His State Letters reveal him as a man intimately aware of international events, a consideration which leaves little doubt that his experience in government had a significant influence on his creative imagination. Fallon also provides a reading of Milton's tracts of 1659–1660, tracing the influence of a decade of public service in his political philosophy and questioning historians' conclusions that he was repudiating Cromwell's Protectorate in his appeal to stave off the Restoration. In a series of radio broadcasts, one of which is translated for the first time in this issue (pp. 21-34), Adorno and Becker claimed that modern education is profoundly inadequate. Their views on education draw heavily on Kant’s notion of Enlightenment as a process for the development of personal and social maturity and responsibility. As such, education cannot just be a training but must itself be a developmental process which takes into account not only social and political realities but also (...) the complex psychodynamics involved in learning. However, Adorno and Becker arrive at a position that is close to self-contradictory, unable to solve the paradox inherent in the idea of an education that is at once authoritative and non-conformist. This might arise from their failure to reflect on the nature of their own dialogue, and it is suggested that friendship offers the social model of a dynamic relationship of the type they sought to articulate. Despite the fact that the discussion took place in 1969, in a climate of educational debate radically different from today’s, their work raises issues and poses questions of the profoundest importance 30 years on. In the updated preface to the 2008 edition of his seminal work The Sublime Object of Ideology, Slavoj Žižek writes that “when a discipline is in crisis, attempts are made to change or supplement its theses within the terms of its basic framework – a procedure one might call ‘Ptolemization’”. The alternative, he claims, is a “true ‘Copernican’ revolution” which takes place “when, instead of just adding complications and changing minor premises, the basic framework itself undergoes a transformation”. In light (...) of these remarks, the central question posed in this paper is as follows: how might Žižek’s distinction between a Ptomelization and Copernican revolution be applied to the field of Žižek Studies today? How, in other words, might we seek to re-evaluate Žižek’s work in a way that includes the mechanisms of evaluation as part of the observed phenomena? The working hypothesis is that, as Žižekians, we must reassert the fundamental rule of psychoanalysis as articulated by Žižek himself: one must remember to include as part of the content of the message communicated, the act of communication itself. In short, when it comes to the reception of Žižek’s thought we should remember Žižek’s basic point that “the question to ask is always: is this truly a Copernician revolution, or merely a Ptolemization of the old paradigm?”. A critical analysis of theories of commercial impossibility and frustration of purpose is best undertaken in conjunction with a theoretical analysis of contract in general. Contracts function as a means of transferring social benefit, which can be subcategorised into subjective and objective benefit. Contracts also regulate the transfer or risk, which is inherent in property and hence any contractual relationship. In the light of the transfer of subjective and objective benefit and risk, contracts can be shown to be by definition (...) ex ante Pareto superior for both parties. Frustration of purpose or commercial impossibility is pleaded where the ex post overall benefit differs greatly from the ex ante expected value. This difference results from the manifestation of a risk which one party bears under the terms of the original contractual risk/benefit equilibrium. Considering the various subjective and objective risks and benefits involved in the contract, it is possible to classify frustrating eventualities under eight heads. In at least six cases the importance of the principle of security of exchange clearly precludes the operation of frustration. One of the remaining cases corresponds with the controversial Krell v Henry; there appears to be a temptation to regard frustration as the most socially utilitarian solution. Given however the dynamics of contractual risk and benefit, allowing frustration there would be unworkable because it would entail placing a subjective risk burden on the party which is in a worse position to evaluate it. There should be no place in the law for a doctrine of frustration of contract on the grounds of commercial impossibility orchanged circumstances. (shrink)

Arguably the biggest challenge in analyzing English tense is to account for the double access interpretation, which arises when a present tensed verb is embedded under a past attitude—e.g., "John said that Mary is pregnant". Present-under-past does not always result in a felicitous utterance, however—cf. "John believed that Mary is pregnant". While such oddity has been noted, the contrast has never been explained. In fact, English grammars and manuals generally prohibit present-under-past. Work on double access, on the other hand, has (...) either disregarded the oddity (e.g., Abusch 1997: 39) or treated it as a reflex of a particular dialect (e.g., Kratzer 1998: 14). The goal of the paper is to argue—based on a corpus study—that a present-under-past sentence is grammatical, but modulated by two, interacting pragmatic phenomena: cessation and parentheticality. Changing technology, and the pervasive demand created by a greater need in the population for access to mental health interventions, has led to the development of technologies that are shifting the traditional way in which therapy is provided. This study investigated the efficacy of a behavioral couples therapy program conducted via videoconferencing, as compared to face-to-face. There were 60 participants, in couples, ranging in age from 21 to 69 years old. Couples had been in a relationship for between 1 to (...) 49 years. The 30 couples were randomly allocated to the face-to-face or videoconferencing group. They all took part in Couple CARE—a couples behavioral education program which promotes self-change in order to increase relationship satisfaction. The six session manualized intervention was offered in an identical manner to all clients, in each condition. Data analysis was based on several questionnaires completed by each couple at pre, post and 3-months follow-up. Results showed that therapeutic alliance ratings did not differ between groups, but increased significantly over time for both groups. Additionally, the results indicated improvements in relationship satisfaction, mental health, and all other outcome scores over time, which did not differ based on condition. This study uniquely contributes to the literature exploring the use of technology to provide therapy. Specifically, the study provides evidence for couples therapy via videoconferencing as a viable alternative to face-to-face interventions, especially for those couples who may not have access to the treatment they require. It is anticipated that the results of this study will contribute to the field of online therapy, and add to fostering confidence in agencies to allow expansion of services conducted via videoconferencing. Contributing to the cultural ecosystem services literature, this paper draws on the in-depth place narratives of two coastal case-study sites in Wales (UK) to explore how people experience and understand landscape change in relation to their sense of place, and what this means for their wellbeing. Our place narratives reveal that participants understand coastal/intertidal landscapes as complex socio-ecological systems filled with competing legitimate claims that are difficult to manage. Such insights suggest that a focus on diachronic integrity (Holland and O'Neill (...) 1996) within place narratives might offer a route to more socially and culturally acceptable environmental management strategies. [Robert Stalnaker] Saul Kripke made a convincing case that there are necessary truths that are knowable only a posteriori as well as contingent truths that are knowable a priori. A number of philosophers have used a two-dimensional model semantic apparatus to represent and clarify the phenomena that Kripke pointed to. According to this analysis, statements have truth-conditions in two different ways depending on whether one considers a possible world 'as actual' or 'as counterfactual' in determining the truth-value of the (...) statement relative to that possible world. There are no necessary a posteriori or contingent a priori propositions: rather, contingent a priori and necessary a posteriori statements are statements that are necessary when evaluated one way, and contingent when evaluated the other way. This paper distinguishes two ways that the two-dimensional framework can be interpreted, and argues that one of them gives the better account of what it means to 'consider a world as actual', but that it provides no support for any notion of purely conceptual a priori truth. /// [Thomas Baldwin] Two-dimensional possible world semantic theory suggests that Kripke's examples of the necessary a posteriori and contingent a priori should be handled by interpreting names as implicitly indexical. Like Stalnaker, I reject this account of names and accept that Kripke's examples have to be accommodated within a metasemantic theory. But whereas Stalnaker maintains that a metasemantic approach undermines the conception of a priori truth, I argue that it offers the opportunity to develop a conception of the a priori aspect of stipulations, conceived as linguistic performances. The resulting position accommodates Kripke's examples in a way which is both intrinsically plausible and fits with Kripke's actual discussion of them. (shrink)

The object of this paper is to study the analogy, drawn both positively and negatively, between mathematics and fiction. The analogy is more subtle and interesting than fictionalism, which was discussed in part I. Because analogy is not common coin among philosophers, this particular analogy has been discussed or mentioned for the most part just in terms of specific similarities that writers have noticed and thought worth mentioning without much attention's being paid to the larger picture. I intend with this (...) analogy (looking at others' comparisons) to shed a little light on what is going on in mathematics, how one can understand it a bit other than experientially. This intention is philosophical and the way that I am attempting to accomplish it is also philosophical. I shall conclude my attempt to explain how it is possible and even natural for mathematics and fiction to have the analogy they have, taking it for granted, as argued in part I, that they are not to be identified. To this end I shall discuss philosophers' comparisons, mainly those of Hodes, Resnik, Tharp, and Wagner, who are the writers that seem to me to have written most thoughtfully and sufficiently extensively about fiction in making the comparison and of Körner, whose comparison is different. Whether either of these comparisons or the more general analogy is of permanent philosophical interest will have to be decided by philosophers now that they have had a fuller examination. I shall mention some other writers' reference to fiction, but not all; indeed, I am sure that I have not even found all the comparisons that there are. (shrink)

           No one owns 'culture'[i]: anyone with a viable theoretical proposal can contend for the right to determine that concept's fate. Not everyone agrees with this view. Throughout its century-long struggle for academic respectability, anthropology has regularly insisted on its unique role as the proprietor of 'culture.' Its variety of approaches and feuding factions notwithstanding, it is this proprietary claim that unifies anthropology to an extent sometimes unrecognized even by its (...) own (post-modernist) practitioners. The history of anthropology has witnessed at least three important moments in the case for autonomous cultural phenomena based, first, on traditional ontological and methodological presumptions, second, on the hermeneutic turn, and third, on postmodern analyses of discourses and their influences.            Historically, anthropologists cite two closely related bases for these proprietary presumptions. The first, which we shall not belabor here, hearkens to inevitably vague discussions about culture's autonomy (with various passes at making sense of the ontological foundations of that alleged autonomy). Cultural anthropologists have advanced such claims for a century, but Geertz' gloss on this topic is representative both in what it endorses and in the vagueness of the grounds for the endorsement. While advancing a host of claims about culture's ontological status (for example, (1) that culture is "ideational," (2) that it, nonetheless, "does not exist in someone's head," (3) that it has the same status--whatever that is--as a Beethoven quartet, and (4) that it is "public"), Geertz insists that "the thing to ask . . . is not what . . . [its] ontological status is." (Geertz 1973: 10-12.) Unfortunately for Geertz and cultural anthropology generally, any convincing case for the autonomy of culture must account for its relations to the things that constitute it. Moreover, because Geertz never relinquishes anthropology's scientific aspirations, the issue of.... Many segments of society have systems of values arising from collective beliefs and motivations. For agriculture, and our food system, increasing production to feed the growing human population clearly is a core value. However, a survey we conducted, together with a previously reported survey, showed that the curricula of most U.S. colleges of agriculture do not offer ethics courses that examine the basis of this core value or include discussion of agriculture’s ethical dilemmas such as misuse of pesticides, not progressing (...) rapidly enough toward sustainability goals, relative lack of involvement in addressing diet-related health issues, and lack of commitment to reducing agriculture’s role as a contributor to global climate change. These surveys provide strong evidence that few students have an opportunity to learn ethical concepts and apply them to issues of importance to the agriculture/food system. We suggest that such issues are both growing societal concerns and serious ethical problems that demand attention if our agricultural/food system is not see its relationship with the public further imperiled. Further, we suggest that there is a need for, indeed an obligation of, the faculty of colleges of agriculture to embrace a thorough analysis and discussion of agriculture’s values and their ethical foundation. We offer our thoughts on why curricula of colleges of agriculture do not provide such opportunities and on the importance of agricultural faculties providing leadership in ethical analysis and discussion. Levine's discussion of Rethinking Religion (1990) and "Crisis of Conscience, Riddle of Identity" (1993) includes some rash charges, some useful comments, and some profound misunderstandings. The latter, especially, reveal areas where we need to clarify and further defend our claims. In the second section we shall discuss the epistemological and methodological issues that Levine raises. Then we shall turn in the third section to theoretical and substantive matters. In fact, Levine remains almost completely silent on substantive matters (except to say (...) that our claims are "obvious" and "trite.") Levine claims, in effect, (1) that religion is outside of the scope of scientific analysis, (2) that our competence approach to theorizing is not necessary for generating the theoretical claims that we make, and (3) that the substantive consequences of those theoretical claims are obvious and trivial. We unequivocally reject the first and third claims and, Levine's profound misunderstandings about the competence approach to theorizing notwithstanding, completely agree with the second. Identifying the confusions in Levine's discussion that inform item (3) will clarify our position. We turn first, though, to matters of epistemology and method (as these bear on items (1) and (2)).
